THIS REGISTRATION AGREEMENT (“AGREEMENT”) GOVERNS YOUR USE OF THE GANJA.CA ONLINE PLATFORM (THE “GANJA.CA SERVICES”) FROM US AND YOUR USE OF THOSE GANJA.CA SERVICES.

IF YOU REGISTER TO GANJA.CA FOR ANY OF ITS SERVICES, THIS AGREEMENT WILL ALSO GOVERN THOSE SERVICES. BY ACCEPTING THIS AGREEMENT, EITHER BY CLICKING A BOX INDICATING YOUR ACCEPTANCE, BY USING THE GANJA.CA SERVICES, OR BY EXECUTING AN ORDER FORM THAT REFERENCES THIS AGREEMENT, YOU AGREE TO THE TERMS OF THIS AGREEMENT. IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF ANOTHER INDIVIDUAL, COMPANY OR LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH PERSON OR ENTITY TO THESE TERMS AND CONDITIONS, AND IN SUCH CASE THE TERMS "YOU" OR "YOUR" SHALL REFER TO SUCH INDIVIDUAL OR ENTITY. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE GANJA.CA SERVICES.

If You have entered into or enter into an agreement with Us for non-Ganja.ca Services, that subscription agreement shall not apply to the Ganja.ca Services, and Ganja.ca Services shall not be considered a service or product or part of any service or product under such subscription agreement, unless otherwise expressly agreed by Us in writing.

You may not access any of the Ganja.ca Services if You are Our direct competitor, except with Our prior written consent. In addition, You may not access the Ganja.ca Services for purposes of monitoring the Ganja.ca Services’ availability, performance or functionality, or for any other benchmarking or competitive purposes.

This Agreement was last updated on March 12, 2017. It is effective between You and Us as of the date You accept this Agreement.

You acknowledge, agree and understand that Ganja.ca is a cloud-based service, which connects patients, prospective patients, medical professionals and Canadian licensed producers.

Ganja and affiliated physician(s) does not provide nor dispense medical marijuana.

  • Ganja does not supply clinical treatment information or medical advice, and does not guarantee or warrant any of the medical advice or clinical treatment information that you may receive through our services.
  • Ganja and affiliated physician(s) will not discuss or provide information regarding alternative methods of obtaining medical marijuana, other than from Health Canada’s authorized list of Licensed Producers under the Access to Marihuana for Medical Purposes Regulations (“ACMPR”).
  • Ganja does not endorse any information, products or services supplied by or obtained from external sources.

I understand that the Terms and Conditions set out in this document contain very important information about medical cannabis (“MC”) that the assigned physician requires by law that I see, read and understand before he or she may grant a prescription and/or authorize the use of MC.

I acknowledge and understand that the assigned medical professional will not establish care for me. He or she will consult and assess the reasonability of my submitted application to use MC to help in treating the medical conditions and related symptoms that I believe; from personal experience, MC to be helpful in helping.

I accordingly confirm that the assessing medical professional will be my medical practitioner to authorize and/or prescribe medical cannabis ONLY and for no other purpose.

I agree not to make any accusation, initiate or partake in any legal actions against the assigned medical professional, his or her practice, my family doctor or any other involved medical professional (including but not limited to specialists) with regards to:

a) My use of MC as a treatment; and

b) My Application, or, prescription for possessing, receiving, and using MC.

I acknowledge and understand that the medical professionals agree that MC may;

  • Distort perception (vision, hearing, feeling, etc);
  • Affect the memory and learning;
  • Impair coordination (it is strongly recommended not to drive for 8 hours after smoking or ingesting cannabis);
  • Impair thinking and problem-solving;
  • Stimulate heart rate and reduces blood pressure; and
  • Produces anxiety, fear, distrust, or panic.
  • I acknowledge and understand that there is an important lack of consensus among medical professionals about:

  • The correct use of MC;
  • The accurate dosage for MC;
  • The risks of smoking MC in contrast to vaporizing or ingesting MC. I agree to avoid mixing marijuana with tobacco. I agree to use my MC only by vaporizer or as an edible product;
  • The long-term health and mental risks connected with the use of MC;
  • The extent to which recurring consumption of MC:

a) May contribute to lung and related infections and respiratory cancer and diseases;

b) May damage the cells in bronchial passages which protect the body against inhaled microorganisms and decrease the ability of the immune cells in the lungs to fight off fungi, bacteria, and tumor cells. For patients with already weakened immune systems, this means an increase in the possibility of dangerous pulmonary infections, including pneumonia;

c) May reduce the strength of various natural immune system mechanisms, including but not limited to macrophages and T-cells;

d) May be related, in some cases, with mental illness, such as bipolar disorder and schizophrenia

I am further aware that the above listed medical concerns are further compounded by the lack of consistency and uniformity in available MC products. With conventional drug products, I generally consume a medication of a accurately known molecular quantity. I recognize that raw plant of MC does function in the same way. I acknowledge that I will get varying compositions of different cannabinoids and varying proportions of different cannabinoids from product to product and even, to a lesser degree, from plant to plant of the same type (strain).

I further acknowledge that there is an important uncertainty and lack of research with regards to the consistency of the MC I may use as medication with which further complicates the use of medicating with an inconsistent treatment like MC.

I am further aware and understand that eating (ingesting) a large dose of MC can cause severe nausea, confusion and disorientation.

I agree and confirm that I have consulted with a physician regarding alternative and conventional treatment options for my medical condition and associated symptoms in considering MC as a medical treatment.

Despite all the medical uncertainties and risks mentioned in this binding document, I truly believe that the benefits of using MC as a treatment for my medical condition(s) and symptom(s) greatly outweigh all the risks and uncertainties.

I understand and agree to receive a “medical document” (i.e. prescription) for medical marijuana only from one (1) medical professional.

I agree to purchase my MC only from a legally authorized licensed producer. I acknowledge and understand that the possession of marijuana from other sources is strictly illegal.

I agree to store my MC securely to prevent any other person to access it either intentionally or by means of an accident. I am aware that individuals under 25 may experience psychosis after consuming MC and will ensure that no infant, child or minors will be exposed to my MC either directly or by indirect means. I will communicate with Poison Control immediately if any infant, child or minor obtains access to my supply of MC.

I am aware and understand that consuming cannabis with other substances, especially sedating substances, may cause harm and possibly even death. I agree to not use illegal drugs (cocaine, heroin, etc.) or controlled substances (narcotics, stimulants, anxiety pills, etc.) that were not prescribed for me.

I will inform the medical professional of all legally controlled substances that are prescribed to me by my doctor(s). I will inform my primary health care professional that I am being prescribed MC. I agree to have a medical evaluation performed by my regular doctor at least every twelve (12) months.

I am aware that MC use is not advisable during pregnancy and breastfeeding. I agree to inform my medical professional if I am pregnant. If I become pregnant while being treated with MC cannabis, I will immediately cease using MC until I have consulted with my medical professional. I acknowledge that this is my decision and I also do not support any claims made by my family, friends and/or other individuals or parties against said clinic and medical professional.

I hereby release Ganja.ca, the consulting physician, his or her clinic, my family physician, and any other involved medical professional from any and all actions, claims, causes of actions, complaints (even by family and friends) and demands for damages, loss, or injury whatsoever arising directly or indirectly as a consequence to my use of MC and my Application to possess MC.

This release from liability is to be binding on heirs, executors and assigns. I also consent to the disclosure, sharing and use of my personal information and medical information by the assigned physician, Ganja.ca and my licensed commercial producer. The information may be used to contact, evaluate and onboard the patient and for analysis and research to better help our members.

I understand and acknowledge that while the assigned medical professional may execute a statement declaring that I stand to potentially benefit from MC, he or she will not serve as my primary care health care professional. As such, I agree to seek regular medical care from my primary care medical professional and that the assigned physician will only deal with assessing his support for my MC use. I also consent to the consulting physician to notify any specialists that I have seen about my decision to use MC and I accept any consequences of such notification.

I agree to notify my primary care medical professional myself about my intent to use MC as a medical treatment given that MC can interact with other medications. If licensed, I agree not to resell or give away any of my medication. I agree to check with local bylaws in my area. I also agree that any legal actions will take place in Ontario and be governed by the laws of Ontario, Canada.
